Strict Liability
Under California law, a dog owner is strictly liable when: (1) Defendant owned the dog; (2) the dog bit Plaintiff while they were in a public place or lawfully on private property; (3) Plaintiff was harmed by the bite; and (4) Defendants dog was a substantial factor in causing the harm to Plaintiff. (CACI No. 463).
California Civil Code section 3342(a) makes clear:
The owner of any dog is liable for the damages suffered by any person who is bitten by the dog while in a public place or lawfully in a private place, including the property of the owner of the dog, regardless of the former viciousness of the dog or the owner’s knowledge of such viciousness.
General Negligence
Under California law, a defendant is liable to a plaintiff when (1) the defendant is negligent; (2) the plaintiff was harmed; and (3) the defendant’s negligence was a substantial factor in causing the plaintiff’s harm. (CACI No. 400).
California Civil Code section 1714(a) makes clear:
Everyone is responsible, not only for the result of her or her willful acts, but also for an injury occasioned to another by her or her want of ordinary care or skill in the management of her or her property or person. This includes being responsible for your dog.
