Special Rules Apply in Trucking Cases
The Federal Motor Carrier Safety Administration carefully regulates truck drivers.
If you or someone you know has been injured in a trucking accident, it is important to find a San Diego trucking accident attorney who is experienced in trucking accidents because the rules for truck drivers are different than that of regular drivers. Our attorneys are experienced and knowledgeable when in comes to the special rules provided by the Federal Motor Carrier Safety Administration (FMCSA) for regulating truck drivers, trucking companies, motor carriers, broker companies, and everyone involved with the use of commercial trucks. Some of those special rules of the FMCSA include, but are not limited to the following:
- Property Carrying Truck Drivers are limited to driving a maximum of 11 hours after 10 consective hours off duty
- Property Carrying Truck Drivers may not drive beyond the 14th consecutive hour after coming on duty, following 10 consectuve hours off duty. Off-duty time does not extend the 14-hour period.
- Property Carrying Truck Drivers may drive only if 8 hours or less have passed since the end of the driver's last off-duty or sleeper berth period of at least 30 minutes.
- Property Carrying Truck Drivers may not drive after 60/70 hours on duty in 7/8 consecutive days. A driver may restart 7/8 consectuve day period after taking 34 or more consectuve hours off duty.
- Property Carrying Truck Drivers using the sleeper berth provision must take at least 8 consecutive hours in the sleeper berth, plus a seperate 2 consecutive hours either in the sleeper berth, off duty, or any combination of the two.
- Before hiring a driver, trucking companies, also known as motor carriers, must obtain motor vehicle records of any prospective driver.
- Motor carriers must investigate the applicant's safety performance history prior to hiring them.
- Motor carriers must check with previous employers to determine if the applicant has violated any drug or alcohol policies in the past.
- Motor carriers must conduct a pre-employment drug test.
- Motor carriers must obtain the driver's medical examiner's certificate by a certified medical examiner.
