What is Fetal Distress During Labor?

Fetal distress is a warning sign that a baby may not be tolerating labor well. When doctors, nurses, or hospitals fail to recognize and respond to concerning signs, the result can be serious birth injury.

Labor and delivery are supposed to be carefully monitored because problems can develop quickly. One of the most important issues during labor is whether the baby is tolerating labor well. When signs suggest that the baby may not be getting enough oxygen or may be under stress, doctors and nurses must recognize the warning signs and respond appropriately.


People often refer to this as “fetal distress.”


Fetal distress can involve concerning changes in the baby’s heart rate, problems with oxygenation, complications with contractions, umbilical cord issues, placental problems, or other events that suggest the baby may be in danger. Not every concerning fetal heart tracing means that a baby will be injured. But some warning signs require prompt evaluation, intervention, closer monitoring, or expedited delivery.

What Does Fetal Distress Mean?


“Fetal distress” is a general term used to describe signs that a baby may not be doing well before or during labor. In modern obstetrics, providers may also use terms such as “nonreassuring fetal status” or “nonreassuring fetal heart rate tracing.”


The phrase does not always mean that a baby has been injured. Instead, it means there are warning signs that require attention.


  • Possible signs may include:
  • abnormal fetal heart rate patterns;
  • recurrent decelerations;
  • prolonged decelerations;
  • minimal or absent variability;
  • tachycardia;
  • bradycardia;
  • uterine tachysystole;
  • umbilical cord compression;
  • placental problems;
  • meconium-stained fluid;
  • maternal infection or fever;
  • maternal low blood pressure;
  • and other concerns during labor.


The key issue is not just whether warning signs appeared. The key issue is whether the medical team recognized them, understood their significance, and responded in time.


How Is a Baby Monitored During Labor?


During labor, the medical team may monitor the baby’s heart rate using fetal heart rate monitoring. This can be done intermittently or continuously, depending on the circumstances and risk factors.


Electronic fetal monitoring creates a fetal heart rate tracing. Nurses, midwives, and physicians review that tracing during labor to evaluate how the baby is responding to contractions and whether there are warning signs that require action.


The fetal heart rate tracing can provide information about:

  • the baby’s baseline heart rate;
  • variability;
  • accelerations;
  • decelerations;
  • contraction frequency;
  • contraction strength;
  • and whether the baby appears to be tolerating labor.


Fetal monitoring is not perfect. It does not answer every question. But it is an important tool for identifying potential problems and deciding whether additional action is needed.


What Are Fetal Heart Rate Decelerations?


A deceleration is a drop in the baby’s heart rate. Some decelerations may be less concerning, depending on timing and context. Others may be more concerning, especially when they are recurrent, prolonged, late in timing, or associated with decreased variability.


Types of decelerations may include:


Early Decelerations

These may occur with contractions and can be related to head compression. They are often less concerning when the rest of the tracing is reassuring.


Variable Decelerations

These can occur when the umbilical cord is compressed. Some variable decelerations may be brief and resolve. Recurrent or severe variable decelerations may require intervention.


Late Decelerations

Late decelerations begin after a contraction starts and recover after the contraction ends. They may raise concern about uteroplacental insufficiency or inadequate oxygen transfer, especially if recurrent or associated with decreased variability.


Prolonged Decelerations

A prolonged deceleration is a significant drop in fetal heart rate lasting longer than a brief deceleration. Depending on the duration and circumstances, it may require urgent evaluation and intervention.


The meaning of any deceleration depends on the full clinical picture, including variability, contraction pattern, maternal condition, labor progress, medications, and how the tracing evolves over time.


What Is Variability and Why Does It Matter?


Variability refers to the normal beat-to-beat fluctuation in the baby’s heart rate. It is one of the important features used to assess fetal well-being during labor.


Moderate variability is generally reassuring because it suggests the baby is tolerating labor. Minimal or absent variability can be concerning, especially when combined with recurrent decelerations or other warning signs.


Providers must evaluate variability in context. Sleep cycles, medications, prematurity, maternal condition, infection, oxygenation problems, and other factors may affect the tracing. The important question is whether the medical team appropriately interpreted the tracing and responded when the pattern became concerning.


What Is Uterine Tachysystole?


Uterine tachysystole generally refers to too many contractions over a period of time. When contractions occur too frequently, the baby may have less time to recover between contractions. This can contribute to concerning fetal heart rate patterns.


Tachysystole may be associated with induction or augmentation medications, such as Pitocin, although it can occur in other circumstances as well.


When uterine tachysystole appears with concerning fetal heart rate changes, the medical team may need to respond by reducing or stopping contraction-stimulating medication, repositioning the mother, giving fluids, evaluating maternal blood pressure, using other intrauterine resuscitation measures, or preparing for delivery if the tracing does not improve.


What Are Category I, II, and III Fetal Heart Tracings?


Fetal heart rate tracings are often described using a three-category system.


Category I tracings are generally considered reassuring.


Category II tracings are indeterminate. They are not clearly normal, but they are not automatically Category III. Category II tracings are common and require ongoing evaluation, clinical judgment, and appropriate response based on the full circumstances.


Category III tracings are abnormal and may require urgent action. If a Category III tracing does not improve with appropriate interventions, expedited delivery may be necessary.


These categories are not just labels. They are part of the process doctors and nurses use to decide whether labor can safely continue, whether intrauterine resuscitation should be attempted, whether additional physician involvement is needed, or whether the baby should be delivered.


How Should Medical Providers Respond to Concerning Signs?


The appropriate response depends on the tracing, the mother’s condition, the baby’s condition, labor progress, gestational age, medications, and the overall clinical picture.


Potential responses may include:

  • increasing monitoring;
  • repositioning the mother;
  • giving IV fluids;
  • reducing or stopping Pitocin or other contraction-stimulating medications;
  • evaluating and treating maternal low blood pressure;
  • treating maternal fever or infection;
  • amnioinfusion in selected cases involving recurrent variable decelerations;
  • notifying the physician or obstetrician;
  • calling for additional help;
  • preparing for operative delivery;
  • preparing for cesarean section;
  • and expedited delivery when appropriate.


The legal issue in a birth injury case is not whether every concerning tracing required a C-section. The issue is whether the medical team acted reasonably based on what was known at the time and whether a delay caused preventable harm.


Delayed C-Section and Birth Injury Claims


Some fetal distress cases involve allegations that a C-section should have been performed sooner. These cases require careful expert review.


Important questions may include:

  • When did the fetal heart tracing first become concerning?
  • How long did the concerning pattern continue?
  • Were contractions too frequent?
  • Was Pitocin reduced or stopped?
  • Did nurses notify the physician?
  • Did the physician evaluate the patient promptly?
  • Was the mother repositioned?
  • Were intrauterine resuscitation measures attempted?
  • Did the tracing improve?
  • If the tracing did not improve, was delivery delayed?
  • Would earlier delivery have changed the outcome?


A delay of minutes may or may not matter depending on the facts. But in some cases, a delayed response to fetal distress can contribute to hypoxic-ischemic injury, neonatal brain injury, or other serious harm.


Hypoxic-Ischemic Encephalopathy and Birth Injury


Hypoxic-ischemic encephalopathy, often called HIE, is a type of brain injury that can occur when a baby experiences inadequate oxygen or blood flow around the time of birth. HIE can range from mild to severe and may be associated with seizures, abnormal neurological exams, therapeutic cooling, abnormal brain imaging, developmental delays, cerebral palsy, and other long-term consequences.


Not every child with HIE has a malpractice case. Birth injury cases require expert evaluation of the prenatal history, labor records, fetal monitoring, delivery timing, neonatal condition, blood gases, imaging, and long-term outcome.


The key question is whether earlier recognition and response to fetal distress would have prevented or reduced the injury.


Evidence That Matters in Fetal Distress Cases


Birth injury cases involving fetal distress are record-intensive. The evidence often includes far more than the delivery note.


Important evidence may include:

  • prenatal records;
  • labor and delivery records;
  • fetal heart monitoring strips;
  • nursing notes;
  • physician notes;
  • midwife notes;
  • Pitocin or induction records;
  • contraction patterns;
  • vital signs;
  • maternal fever or infection records;
  • medication records;
  • operative reports;
  • C-section timing records;
  • delivery records;
  • cord blood gases;
  • Apgar scores;
  • neonatal resuscitation records;
  • NICU records;
  • therapeutic cooling records;
  • EEG records;
  • brain imaging;
  • pediatric neurology records;
  • developmental records;
  • and expert review.


Families may also have important information about what they were told, when providers entered the room, how urgent the situation appeared, when a C-section was discussed, and what happened after delivery.


When Can Failure to Respond to Fetal Distress Be Malpractice?


Failure to respond to fetal distress may be malpractice if a health care provider failed to meet the applicable standard of care and that failure caused injury.


Potential issues may include:

  • failure to properly monitor the baby;
  • failure to recognize abnormal fetal heart rate patterns;
  • failure to respond to recurrent late decelerations;
  • failure to respond to prolonged decelerations;
  • failure to recognize minimal or absent variability;
  • failure to address uterine tachysystole;
  • failure to reduce or stop Pitocin;
  • failure to notify the physician;
  • failure of the physician to respond promptly;
  • failure to call for additional help;
  • delayed decision for C-section;
  • delayed delivery after the decision for C-section;
  • inadequate neonatal resuscitation;
  • and failure to transfer to a higher level of care when needed.


A malpractice claim requires more than showing that the baby had a bad outcome. The case must show that the care fell below the standard of care and that the negligence was a substantial factor in causing harm.


California Birth Injury Deadlines


California medical malpractice cases have special deadlines. In general, medical malpractice cases may be subject to a one-year deadline after discovery of the injury and a three-year outside deadline from the date of injury, subject to limited exceptions and special rules.


Medical malpractice cases also may require a 90-day notice before filing suit against a health care provider.


Birth injury cases involving minors may involve additional rules, but families should not wait. Medical records must be requested, reviewed, organized, and evaluated by qualified experts before a lawsuit is filed.
